consultation to decide future

Today, 24th december, i go to talk to a lawyer who study in Monash university before to get a clear idea so that i could decide whether to study in malaysia or australia under jpa scholarship.Below are the content of the consultation

Tan : Is Australia law compatible with malaysia law? Will we face any difficulty practising in malaysia?

lawyer ng : As far as i am concern, the basic principle of Australia law is the same
as malaysia law as we are commonwealth Malaysia' land law is almost the
with malaysia's land law because it follow australia's torrens land law.
In one way or another, contract law, company law,is the same. The only
difference is that the case law is different .But that should not be a
problem as you can learn it latter during chambering or clp.

Tan: But we need to do clp , which is quite hard to pass.

Lawyer ng: I am in the bar council and we already finish the syllabus of CBE. CBE is a common bar exam where graduate from local or foreign university will
have to sit for this exam. It will replace clp in a few year time( 3year)
So i think is should not be a problem for you as everyone would have to sit for the exam and we would stadardise it and maintain the quality
I think it should not be a problem for you as you excel in english . The
main problem people cannot pass clp is that their language is poor and
they cant even answer the question accurately. If you are really good,
you should not be worrying too much.

Tan : OIC, haha,maybe i worry too much d.

Lawyer ng: It depend on yourself la,what you want and your ability.

Tan: I heard that you graduate form Monash University. How is the university? Is the
education there good?

Lawyer ng: Certainly, the quality of education there is good.Monash University focus
on practical aspect of law and there are many Asian student there. There
even got malaysia student law society which i am former president. Now
Australia university try to integrate other subject with law.It is
favourable that you do double degree there. But if jpa dont allow, you
can still study other subject together with law. After graduate, i got
scholarship to study my master there as i was among the top 5% in the
examination.I fell grateful to australia government provide
assistance disregard of your race and country origin. The best will
be rewarded, where we compete on a fair ground basis.

Tan :Which University is the best to study law?

Lawyer ng: As far as i know, Monash, Melbourne , NSW , Sydney, and adelaide are the
best. But i reccommend you to go monah or melbourne. There got more Asian
and malaysian and you would not feel left out.Adelaide also not bad, but
not as famous as others. ANU situated in Canberraand there is like
putrajaya, lifeless and dull , mainly for administration.

Tan: The main reason why i want to stay local is that i want go UIA to study syariah
law.Do you think i should study syariah law.

Lawyer ng: Syarah law is a small branch of law, mainly deal with petty case like
divorce.I dont think you should study it la. No malay would trust you to
fight their case. There are many other brach of law where you can earn big
money.

Tan : IS UIA good?

lawyer ng: The student i met who graduate form UIA are not very well equipped and
and has poor command of english because they study mainly in malay.
Moreover, local university standard are very low.

Tan :Is there any discrimination in Australia?

lawyer ng: I dont think so. Australian value your effort and talent. They give same
treatment to everyone.

Tan: How long you work before you open your own law firm?

Lawyer Ng: i work for 2 years in kl before opening my own law firm. I dislike the
hustle and bustle in KL .Life in Malacca is more peaceful and relaxing.
Morever, lawyer here are nice and seldom use underhand tactic to
win.

Tan:What type of law you practice?

lawyer ng:I do all type of cases as malacca is a small state. But mostly i do
litigation.

Tan: Thanks for all the advice.

lawyer ng:elcome
